By accessing or using dmcaqloud.com services, you agree to be bound by these Terms of Service ("Terms"). We reserve the right to update, suspend, or terminate services at our discretion. Violations, including illegal activities or policy breaches, may result in immediate account suspension or termination without notice. Review these Terms regularly—your continued use constitutes acceptance of changes.

These Terms form a binding agreement between dmcaqloud.com ("we," "us," or "our") and you ("Customer," "you," or "your"). Effective November 3, 2025.

1. Delivery of Services

We provide offshore VPS, streaming, storage, and DMCA-ignored hosting services in Amsterdam, subject to these Terms.

  • You agree to pay all fees for initial terms, renewals, add-ons, emergency services, and supplements as outlined in your plan.
  • You authorize us to perform necessary services, including security updates, and agree to pay associated costs.
  • Services commence upon payment confirmation; setup is instant for eligible plans.

2. Use of Services

To maintain network integrity and compliance, all usage must align with these policies. We promote freedom but prohibit harm.

2.1 Resources & Bandwidth

  • Use only allocated disk space, bandwidth, CPU, and resources per your plan.
  • Overages incur additional fees; chronic overuse may require plan upgrades.

2.2 Resource Sharing

  • Sharing resources with non-account holders is permitted for personal use.
  • Reselling services, accounts, or resources without written permission results in permanent termination.

2.3 Prohibited Activities

As an offshore provider, we ignore DMCA notices but strictly ban illegal or harmful content. Violations lead to immediate termination, data deletion, and no refunds.

  • Child exploitation or pornography.
  • Illegal drugs, weapons, or illicit markets.
  • Bulk unsolicited email (spam) tools or services.
  • Phishing, malware, or scam sites (e.g., Ponzi schemes).
  • Terrorist content, torture depictions, necrophilia, bestiality, or related material.
  • Hacking tools, exploits, viruses, DoS attacks, or network scans.
  • Defamatory, copyrighted, or trademark-violating content (beyond DMCA scope).

Report suspected violations to abuse@dmcaqloud.com.

2.4 Security & Updates

  • You consent to automated updates, patches, and vulnerability scans for server safety.
  • We reserve rights to mitigate threats, including temporary suspensions, without liability.

3. Fees, Payments & Invoicing

All fees are non-refundable except as specified. We accept crypto for anonymity.

3.1 Payment Terms

  • Pay within 3 days of invoice issuance via client portal.
  • Coupons apply only to Shared/VPS plans; no stacking.
  • Late payments (Day 4+) trigger suspension; Day 16+ leads to termination and data purge.

3.2 Invoicing

Invoices are emailed and available in your client area. We are not liable for spam filters.

3.3 Cancellations

  • Cancel anytime via client portal (4+ days notice for prorated billing).
  • No liability for unintended charges; we do not store payment details.
  • Cancellation deletes all data—back up independently.

4. Refunds & Warranties

  • 14-day money-back guarantee for Shared/VPS plans (setup fees excluded).
  • No refunds for Dedicated Servers, add-ons, or post-14-day usage.
  • Licenses (e.g., software) are non-refundable but transferable.
  • Warranties void on breaches; 99.9% uptime targeted, not guaranteed (maintenance excluded).

5. Intellectual Property Rights

We retain all rights to our technology, trademarks, and IP. You grant us a limited license to host your content.

  • No reverse engineering, decompiling, or sharing of our code/services.
  • Violations result in termination and potential legal action.
  • You warrant your content does not infringe third-party rights.

6. Limitations of Liability

To the fullest extent permitted by Dutch law, we disclaim all liability.

  • No responsibility for data loss, downtime, profits, or indirect damages.
  • You indemnify us against claims from your use or third-party actions.
  • Force majeure (e.g., DDoS, legal orders) excuses performance.

6.1 Third-Party Disclaimer

Do not share credentials or data; we are not liable for unauthorized access.

6.2 Abuse Policy

  • Prohibit DoS, scans, exploits, or resource abuse—immediate investigation and termination.
  • Excessive CPU/RAM triggers suspension and upgrade prompts.
  • Staff harassment results in service denial without refund.

7. Governing Law & Disputes

These Terms are governed by Dutch law. Disputes resolved in Amsterdam courts. For EU users, GDPR applies where relevant.
